Governance, Rule of Law & Institutions

The rule of law is the foundation of any functioning democracy. In Nigeria, it is clearly provided for in the Constitution, which guarantees equality before the law and independence of the judiciary.

However, in reality, governance is increasingly shaped by discretion, influence, and weak enforcement rather than the supremacy of law. Court decisions are often ignored, institutions are weakened, and public trust continues to decline.

A nation cannot develop where laws are optional. When the rule of law is weak, governance collapses, corruption thrives, and citizens lose faith in the system.

Issues

Nigeria’s governance and justice system is weakened by deep structural failures:

  • Weakening of Political Pluralism and Democratic Balance: Nigeria’s democracy is increasingly affected by the dominance of a single political force at different levels of government, weakening opposition participation, reducing accountability, and limiting the diversity of ideas needed for effective governance. When political competition is weakened, institutions become less responsive, and citizens lose confidence in democratic processes.

  • Disobedience of Court Orders: Government institutions and security agencies frequently disregard valid court rulings, weakening the authority of the judiciary and creating a culture of impunity.
  • Systemic Corruption: Corruption continues to undermine public institutions, distort justice, and allow influence and wealth to override fairness and accountability.
  • Weak and Overburdened Judiciary: The justice system suffers from long delays, case backlogs, and limited independence, making timely justice inaccessible to many Nigerians.
  • Weak Institutional Frameworks: Institutions meant to enforce laws are often weak, under-resourced, or influenced by political interests, reducing their effectiveness.
  • Human Rights Violations: Arbitrary arrests, unlawful detentions, and abuse of power by enforcement agencies continue to undermine public confidence in governance.

  • Low Public Trust in Institutions: Citizens increasingly avoid formal justice systems due to delays, corruption, and lack of confidence in outcomes.
  • Poor Regulatory Environment: Conflicting laws, weak enforcement, and inconsistent regulation discourage investment and slow economic growth.

Solutions

Restoring governance and the rule of law requires strong institutions, accountable leadership, and systems that work for all citizens—not just a few. A Makinde Administration will deliver reforms that rebuild trust and strengthen institutions.

  • Strengthen Democratic Pluralism and Political Competition: Ensure a level playing field where all political parties can operate freely, compete fairly, and contribute to governance. Strengthen electoral integrity, enforce neutrality of electoral institutions, and protect opposition rights to promote accountability, prevent power concentration, and safeguard Nigeria’s democracy.
  • Strengthen Judicial Independence:Ensure the judiciary operates free from political interference through merit-based appointments and full institutional autonomy.
  • Guarantee Financial Autonomy of the Judiciary:Provide independent funding structures to reduce dependence on the executive and strengthen judicial integrity.
  • Enforce Compliance with Court Orders:Establish a governance culture where all arms of government strictly obey judicial decisions, reinforcing respect for the rule of law.
  • Accelerate Judicial Reform and Case Management:Introduce digital case management systems, e-filing, and virtual hearings to reduce delays and eliminate backlog.
  • Strengthen Anti-Corruption Institutions:Empower agencies like the EFCC and ICPC to operate independently, with stronger capacity to investigate and prosecute without political interference.
  • Reform Law Enforcement Agencies:Improve training, welfare, and accountability of police and security institutions to ensure professionalism and respect for human rights.
  • Expand Access to Justice:Strengthen legal aid systems so that justice is accessible to all citizens, not just the privileged.
  • Institutionalise Alternative Dispute Resolution:Promote mediation and arbitration to reduce pressure on courts and ensure faster resolution of disputes.
  • Promote Civic Education and Legal Awareness:Increase public understanding of rights, responsibilities, and legal processes to strengthen citizen participation and accountability.

Nigeria cannot achieve progress without strong institutions and respect for the rule of law. When laws are weak, governance fails. When institutions are compromised, citizens suffer.

Restoring trust in governance requires rebuilding institutions that are independent, accountable, and effective.
